1. Acceptance
These Terms of Use govern your use of ArcoTalk and related services provided by Arco App Studios. By creating an account, using ArcoTalk, or purchasing translation credits, you agree to these Terms. If you do not agree, do not use the service.
2. The ArcoTalk Service
ArcoTalk is a two-person spoken translation application. It uses automated speech recognition, machine translation, and text-to-speech technology. ArcoTalk is not a certified interpreter, and translations may contain errors, omissions, delays, or misunderstood names, numbers, dialects, or context.
Do not rely on ArcoTalk as the sole source of information for medical, legal, financial, emergency, safety-critical, or other high-risk decisions. Verify important information with a qualified person or another reliable source.
3. Accounts and Identity
An authenticated account is required to use ArcoTalk’s shared credit balance. Your Firebase user ID identifies your account across supported devices and storefronts. You are responsible for maintaining control of your sign-in credentials and for activity performed through your account. Translation credits and account benefits may not be transferred, resold, or combined between different accounts.
4. Translation Credits
Each authenticated account receives 100 starter translation credits once. Each successfully completed translation consumes one credit. Invalid requests and translations that fail before completion do not consume a credit.
Additional credits may be purchased in prepaid packs. Credits have no cash value, are non-transferable, and cannot be redeemed for money. Credits do not reset monthly. They remain available while the account and ArcoTalk service remain available, subject to approved refunds, payment reversals, account corrections, these Terms, and applicable law.
The balance shown by ArcoTalk’s backend records is authoritative. If a temporary display difference occurs, the server-side account and transaction ledger control.
5. Personalization
Personalization features become available to an account after its first verified, non-refunded credit-pack purchase. Spending the purchased credits does not remove personalization access. If every qualifying purchase is refunded, reversed, or charged back, personalization access may be removed.
6. Purchases, Billing, and Refunds
Direct web purchases are sold and processed by Paddle, which acts as merchant of record. Paddle handles payment processing, applicable taxes, receipts, and eligible refund requests under the Paddle Buyer Terms and Paddle Refund Policy shown during checkout. Purchases made through an app store are also subject to that storefront’s terms and refund procedures.
Prices, currencies, taxes, and payment methods are shown before checkout. Credit packs are one-time purchases and are not subscriptions. Purchased credits are normally granted to the ArcoTalk account identified during checkout after payment verification.
An approved refund, reversal, or chargeback may remove the credits originally granted by that transaction, up to the account’s remaining available balance. ArcoTalk may update the transaction ledger and personalization status to reflect the reversal. Nothing in these Terms limits any non-waivable consumer right under applicable law.
7. Acceptable Use
You may not use ArcoTalk to violate law, infringe another person’s rights, harass or exploit others, interfere with the service, evade credit accounting, attempt unauthorized access, reverse engineer protected service components, automate abusive traffic, or resell access without written permission.
8. Intellectual Property
ArcoTalk, its software, branding, interface, and original materials are owned by or licensed to Arco App Studios. These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable right to use ArcoTalk for its intended purpose. They do not transfer ownership of ArcoTalk or any intellectual property.
9. Availability and Changes
ArcoTalk requires compatible devices, network access, authentication, and third-party services. We may maintain, update, suspend, or change the service to improve reliability, security, legal compliance, or functionality. We do not guarantee uninterrupted availability or support for every device, language, country, or storefront.
If ArcoTalk is permanently discontinued, we will handle remaining purchased credits as required by applicable law. Starter credits and promotional benefits are not redeemable for cash.
10. Privacy
Use of ArcoTalk is governed by the ArcoTalk Privacy Policy. This policy explains how account identifiers, translation requests, prepaid-credit records, purchase information, and personalization status are processed. Payment providers and storefronts also process payment and transaction information under their own privacy notices. Arco App Studios does not receive or store full payment-card details.
11. Disclaimers
To the fullest extent permitted by law, ArcoTalk is provided “as is” and “as available.” We disclaim implied warranties that may legally be disclaimed, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that translations will be complete, accurate, timely, or suitable for a particular use.
12. Limitation of Liability
To the fullest extent permitted by law, Arco App Studios is not liable for indirect, incidental, special, consequential, or punitive damages, loss of data, loss of profits, or harm caused by reliance on a translation. Where liability cannot be excluded, our aggregate liability relating to ArcoTalk will not exceed the amount you paid for ArcoTalk products during the twelve months before the event giving rise to the claim. Mandatory consumer protections remain unaffected.
13. Suspension and Termination
You may stop using ArcoTalk at any time. We may suspend or terminate access when reasonably necessary to address fraud, abuse, security risks, unlawful conduct, material violations of these Terms, or legal requirements. Suspension does not eliminate rights or remedies required by applicable law.
14. Changes to These Terms
We may update these Terms when ArcoTalk, its payment model, service providers, or legal obligations change. The effective date will be updated for material changes. Continued use after updated Terms take effect constitutes acceptance where permitted by law.
15. Governing Law
These Terms are governed by the laws of the Republic of Armenia, without regard to conflict-of-law principles. Courts with jurisdiction in Armenia may hear disputes, except where mandatory consumer law gives you the right to bring a claim elsewhere.
